Code of Conduct for Communication in Chat

1. General information

Lotum one GmbH, Am Goldstein 1, 61231 Bad Nauheim ("Lotum") operates a chat function or a chat service ("Chat Service") in selected games and products ("Games"). Chat Services are provided to Users for entertainment purposes only. Users shall be able to exchange information here on a subject-specific basis (i.e. in connection with the relevant Games). Users can, for instance, arrange to play together, support each other with tips and share their gaming experiences with other users.

The use of the Chat Services is intended to bring the gaming community together and to promote playing together. Be aware of this before posting messages on a Chat Service and contacting other users.

2. Responsibility of the author

The author of a message is solely responsible for its content. Lotum shall not be liable for the content of messages transmitted. Opinions expressed by Users in Chat Services do not reflect the views of Lotum. Lotum does not appropriate or approve of the content or opinions of Users. If a User sends you a link to a website operated by a third party, we have no control over and accept no responsibility for the content of that website.

Please note that Lotum only transmits Users' messages to the addressees. A content check is not carried out prior to transmission. Do not blindly trust the contents of a message. This applies in particular to senders whom you do not know personally.

3. Fair interaction with other Users

The Chat Services are made available to Users for the free exchange of ideas. However, we always ask you to use considerate and fair language in discussions and when expressing opinions. Please use language that you would also accept in replies to your messages and remember that the use of the Chat Services is intended to benefit the (gaming) enjoyment of all Users. Be careful not to share personal data such as passwords, pictures or addresses with strangers.

4. Inadmissible content

When using the Chat Services, no illegal or immoral content may be transmitted, disseminated or published. This includes, in particular, content that

The sending of spam, advertising and chain letters is prohibited. It is also prohibited to send links to or references to external websites, databases or other servers with content of the type mentioned above. In particular, it is prohibited to link to or refer to illegal, pornographic offers and websites or offers and websites harmful to minors as well as to programmes that contain or distribute malware or cheat software.

5. Handling of unlawful content

If you feel harassed by a message or are affected by a violation of the above Code of Conduct, the following options are available to you.

Of course, you can write to the sender of the message and point out the inappropriate behaviour. Please remain objective and in particular do not allow yourself to be carried away by insulting statements. Always bear in mind that the sender may deliberately want to provoke you in order to be able to report you to Lotum afterwards. So keep cool.

You can interrupt individual communication with a User at any time by blocking that User in the Chat. Blocking a User means that this User cannot send you any further messages or game requests and, if applicable, Games that have been started together cannot be finished.

You can report a Chat to Lotum for review. To do this, select the option "Report chat" from the chat menu in the Chat Service. If you report a Chat, this will also automatically lead to a blocking of the corresponding User.

Please note that abusive reporting on your part is a violation of this Code of Conduct. An abusive report is usually given when obviously unfounded reports about a particular User are repeatedly received or when a User repeatedly gives obviously unfounded reports about other Users.

Under certain circumstances, you can also take legal action against the sender of a message (for example, in the case of insulting content). You should seek advice on the legal procedure in advance, for example from a lawyer. Please note that for data protection reasons, we may only disclose information about the sender within the framework of existing laws.

6. Virtual domestic authority

Messages that violate the above Code of Conduct or messages with content unrelated to the subject matter may be deleted by Lotum. Lotum does not usually send out reasons for individual deletions. Should a rule violation not be obvious, you are welcome to inquire about the reason for a deletion by sending an e-mail to games@lotum.de.

In the event of repeated violations of the Code of Conduct and after prior threat of blocking, the Chat Service of the corresponding game account ("Account") may be blocked for a period of 1, 5 or 10 days, depending on the severity of the violation. A blocking will exclude the User from the Chat Services. Lotum will inform the User of the reason for the blocking. After repeated blocking, the Chat Service may also be blocked permanently by Lotum.

The threat of blocking is dispensable if the User violates this Code of Conduct in a particularly serious manner and a consideration of the interests of both parties justifies the immediate blocking of access. A particularly serious violation shall be deemed to have occurred in particular if Users disseminate child pornographic or hate speech content or malware or otherwise violate criminal laws. Even a single particularly serious violation can lead to a permanent blocking of the Chat Service.

A violation of this Code of Conduct may also lead to a blocking of the Account. Further information on this can be found in Section 8 of the Terms of Service for Mobile Games of Lotum one GmbH.

7. Further legal information

By participating in the Game, you accept this Code of Conduct for Communication in the Chat as binding.

Please note that our Terms of Service for the Mobile Games of Lotum one GmbH ("TOS", https://lotum-legal.web.app/lotumone/en/terms.html) continue to apply. Should individual rules of conduct conflict with our TOS, the provisions set out in our TOS shall always take precedence.
